Acceptable Usage Policy

You agree that our continued provision of services to you, and your continued use of them, represent your agreement to be bound by our terms and conditions of service.

Introduction

This acceptable use policy governs the usage of our Hosting Services provided by Voteq. By utilizing our Hosting Services, you acknowledge and agree to adhere to all the policies outlined in this acceptable use policy, which supplements our terms and conditions. We reserve the right to modify this policy at any time without prior notice.

You are strictly prohibited from granting access to or permitting any third party to use our Hosting Services, except in the case of our reseller hosting packages. If you opt for a reseller hosting package, you may grant access to a third party (“Third Party”) to utilize our Hosting Services. However, please note that the Third Party will also be subject to the terms and conditions of this acceptable use policy. It is your responsibility to monitor the Third Party’s usage of our Hosting Services and ensure their compliance with this policy. Any violation of this acceptable use policy by a Third Party will be deemed as a violation by you.

Our Hosting Services are provided by Voteq (“we,” “us,” or “our”). We are a registered company in England and Wales under company number 11391961, with our registered office located at 32 Eyre St, Sheffield, S1 4QZ, United Kingdom. If you have any questions or concerns regarding this policy or our services, please don’t hesitate to contact us.

1. Resource usage

  • 1.1. Our Shared Hosting Services entail providing you with web space on our servers, enabling you to upload and publish website pages and files.
  • 1.2. With our Shared Hosting Services, you are granted “unlimited” server space for regular web usage that does not involve file distribution. However, for websites that involve the downloading of video, audio, or other files, we reserve the right to impose a monthly bandwidth limit of two hundred and fifty (250) gigabytes.
  • 1.3. The aforementioned bandwidth limit only applies to file distribution activities and will not affect non-file-distribution usage.
  • 1.4. When utilizing our Shared Hosting Services (excluding the use of your own virtual private server), you are prohibited from:
    • 1.4.1 Utilizing more than 10% of our platform’s processing capacity. This includes activities such as CGI scripts and resource-intensive FTP, PHP, or HTTP operations.
    • 1.4.2 Running stand-alone, unattended server-side processes or any daemons, including IRCd.
    • 1.4.3 Running any type of web spider or indexer.
    • 1.4.4 Running any software that interacts with an Internet Relay Chat network.
    • 1.4.5 Running any bit torrent applications, trackers, or clients. You are permitted to link to legal torrent files from external sources, but hosting or storing them on our servers is strictly prohibited.
    • 1.4.6 Engaging in any file-sharing or peer-to-peer activities.
    • 1.4.7 Operating gaming servers.
    • 1.4.8 Running entries or other scheduled tasks, except through our control panel configuration.
    • 1.4.9 Providing web space under a domain to third parties, including Resellers offering free websites.
    • 1.4.10 Operating a proxy website or service.
    • 1.4.11 Serving as a remote file host for other websites.
    • 1.4.12 Operating self-hosted file synchronization or similar “cloud storage” services, including but not limited to OwnCloud, Pydio, and Sparkleshare.
  • 1.5. The Hosting Services must not be utilized as an offsite backup facility. Therefore, any files uploaded to our servers as part of your usage of the Hosting Services must be visible and accessible to the outside world (web-visible), unless they are essential for the operation of the associated website. We retain the right to delete files or directories that are not web-visible without prior notice to you.
  • 1.6. All website pages stored on our servers as part of the Hosting Services will be made available to search engines unless you take measures to prevent this. If you intend to optimize your web pages for search engines, you agree to employ coding and techniques that fully comply with the guidelines established by major search engines such as Google, Bing, Yahoo, and others.
  • 1.7. MySQL Databases are limited to a size of 1024 megabytes. In the event that a database reaches this size, we will notify you accordingly.
  • 1.8. If you are a Reseller and choose to deactivate a resold web hosting account, please be aware that we will delete it after a period of 50 days.

2. Prohibited uses

  • 2.1. Your use of the Hosting Services must be in compliance with all applicable laws and regulations. It is strictly prohibited to use the Hosting Services:
    • 2.1.1 In a manner that violates any local, national, or international law or regulation.
    • 2.1.2 For any unlawful or fraudulent activities or with any unlawful or fraudulent intent.
    • 2.1.3 To harm or attempt to harm minors in any way.
    • 2.1.4 To send, receive, upload, download, or use any material that does not adhere to our content standards (see below).
    • 2.1.5 To transmit, or solicit the sending of, unsolicited or unauthorized advertising, promotional materials, or any form of solicitation (commonly known as SPAM – see below).
    • 2.1.6 To knowingly transmit any data, upload or send any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or computer code designed to disrupt or harm computer systems or data.

3. Content standards

  • 3.1. The following content standards are applicable to all material hosted through the Hosting Services, including any interactive services associated with it.
  • 3.2. You are required to adhere to the principles outlined in these standards. They apply to each part of any material as well as to the material as a whole.
  • 3.3. Material must:
    • 3.3.1 Be accurate when stating facts.
    • 3.3.2 Represent genuinely held opinions when expressing subjective views.
    • 3.3.3 Comply with the relevant laws in the United Kingdom and any other country from which the material is posted.
  • 3.4. Material must not:
    • 3.4.1 Contain defamatory statements or content that harms the reputation of any individual.
    • 3.4.2 Include obscene, offensive, hateful, or inflammatory material.
    • 3.4.3 Feature explicit pornographic content.
    • 3.4.4 Promote or incite violence.
    • 3.4.5 Encourage or propagate discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
    • 3.4.6 Infringe upon the copyrights, database rights, or trademarks of others.
    • 3.4.7 Have the potential to deceive or mislead others.
    • 3.4.8 Violate any legal obligations owed to third parties, such as contractual or confidentiality obligations
    • 3.4.9 Promote or facilitate any illegal activities.
    • 3.4.10 Threaten, abuse, invade privacy, or cause unnecessary annoyance, inconvenience, or anxiety to others.
    • 3.4.11 Harass, upset, embarrass, alarm, or disturb any individual.
    • 3.4.12Use false identities or misrepresent your affiliation with any person or entity.
    • 3.4.13 Create the false impression that the material originates from us, if that is not the case.
    • 3.4.14 Advocate, promote, or assist in any unlawful activities, such as copyright infringement or computer misuse.

4. Zero tolerance spam policy

  • 4.1. We have a strict policy against the sending of unsolicited email, bulk emailing, and spam. Any user found to be sending spam may have their account terminated, with or without notice.
  • 4.2. Hosting of websites that are advertised as spam is strictly prohibited on our servers. This includes spam sent through fax, phone, postal mail, email, instant messaging, or newsgroups. If any user account results in our IP space being blacklisted, it will be immediately suspended and/or terminated.
  • Voteq Limited reserves the right to request changes or disable any website, account, database, or component that does not comply with our policy.
  • In cases where unsolicited email is sent, Voteq Limited reserves the right to charge the account holder a clean-up fee or any expenses incurred for blacklist removal, at our sole discretion.

5. Reselling

  • 5.1. You agree not to:
    • 5.1.2 re-sell or offer for the use of third parties any part of our Hosting Services unless a specific Reseller product has been purchased,
    • 5.1.2 not to access without authority, interfere with, damage or disrupt
      • 5.1.2.1 any part of the Hosting Services
      • 5.1.2.2 any equipment or network used to provide the Hosting Services
      • 5.1.2.3 any software used in the provision of the Hosting Services
      • 5.1.2.4 any equipment or network or software owned or used by any third party
    • 5.1.3 If you deactivate a resold Hosting Service for 50 consecutive days we will automatically delete this Hosting Service.
    • 5.1.4 You are responsible for the good housekeeping of your Reseller Service. You agree to delete files and Hosting Services that are no longer required

6. Suspension and termination

  • 6.1. We reserve the right to determine, at our discretion, whether there has been a breach of this acceptable use policy through your use of the Hosting Services. If a breach occurs, we may take appropriate action as we see fit.
  • 6.2. Non-compliance with this acceptable use policy constitutes a significant violation of our terms and conditions of sale, which grants you the privilege of using the Hosting Services. Such non-compliance may result in any or all of the following actions:
    • 6.2.1 immediate, temporary, or permanent revocation of your right to use the Hosting Services
    • 6.2.2 immediate, temporary, or permanent removal of any Material (as defined in paragraph 5.1) uploaded to our servers
    • 6.2.3 issuance of a warning to you
    • 6.2.4 initiation of legal proceedings against you to recover all costs incurred as a result of the breach, including reasonable administrative and legal expenses, on an indemnity basis
    • 6.2.5 pursuit of further legal action against you
    • 6.2.6 disclosure of relevant information to law enforcement authorities as reasonably deemed necessary.

7. Changes to our policy

  • 7.1. We reserve the right to update or modify this acceptable use policy at any time by making changes to this page. It is your responsibility to periodically review this page and take note of any amendments, as they are legally binding upon you.
